Surveys, Land Encroachments, Servitudes, and Acquisitive Prescription

The purpose of this continuing education course is to provide the attendees with a basic overview of boundary surveys, encroachments, servitudes, and acquisitive prescription. The four topics tend to go hand in hand with each other when disputes arise and when these disputes go to trial. By the end of this course, the attendees should possess an understanding as to the importance of boundary surveys and how they can prevent litigation; how to tactfully handle instances of encroachments as well as the rights of a property owner in the event that an encroachment does exist; a very general understanding as to the types of servitudes that exist as well as the rights of servient and dominant estates; and an understanding of the requirement for good faith and bad faith acquisitive prescription.
